   The German Federal Ministry for the Environment, Nature Conservation,
   Building and Nuclear Safety (BMUB, the ultimate commissioning party)
   has commissioned GIZ to implement the overall project. The objective of
   the overall project is to assure global abatement of N2O emissions from
   nitric acid production by 2020. Its vision is to incentivise the
   installation of appropriate abatement technologies in all nitric acid
   production plants worldwide. The present contract shall support GIZ in
   the decision-making process of closing grant agreements with nitric
   acid producers in several countries to achieve this objective by
   conducting one or several technical and commercial Due Diligence
   Assessments of one or several nitric acid production plant(s).

   II.2.4)Beschreibung der Beschaffung:
   GIZ is seeking for external support from a contractor with relevant
   expertise for conducting one or several technical and commercial Due
   Diligence Assessments of one or several nitric acid production
   plant(s). The maximum number of Due Diligence Assessments to be
   conducted under this contract is ten (10). The actual nitric acid
   production facilities where the Due Diligences shall be conducted are
   not yet clarified and will be determined at a later stage. However,
   respective nitric acid plants will be located in one or several
   countries as lined out in the "list of countries" in the ToR.
   The aim of each Due Diligence is to provide GIZ with a sound analysis
   on the level of technical and commercial risks of the specific
   production facility or facilities under assessment, as well as of the
   likelihood of the occurrence of not intended negative events and their
   potential impacts. For this purpose, the contractor must follow the
   procedure laid out in the guiding documents, which are attached to
   these terms of reference. These must be used by the contractor to
   conduct the Due Diligence Assessment(s) at the respective nitric acid
   plant(s). Based on the findings of the Due Diligence, it is expected
   that the contractor expresses a conclusion on whether any risks have
   been identified that should prevent GIZ from signing a grant agreement
   with the respective plant operator.
   Each Due Diligence Assessment can be separated into a technical and a
   commercial Due Diligence Assessment, which must be understood as a
   joint process. One complete assessment consists of a technical and a
   commercial assessment. These will always be commissioned jointly. Note
   that, in order to save resources and reduce travel activities, the
   contractor should be able to combine several Due Diligence Assessments
   (joint technical and commercial Due Diligence Assessment) if the
   conditions allow for this (nitric acid plants in same country, operated
   by same company, or similar).

   of Competition (GWB), application for review is not permissible insofar
   as:
   1. the applicant has identified the claimed infringement of the
   procurement rules before submitting the application for review and has
   not submitted a complaint to the contracting authority within a period
   of 10 calendar days; the expiry of the period pursuant to Article 134,
   Section 2 remains unaffected;
   2. complaints of infringements of procurement rules that are evident in
   the tender notice are not submitted to the contracting authority at the
   latest by the expiry of the deadline for the application or by the
   deadline for the submission of bids, specified in the tender notice;
   3. complaints of infringements of procurement rules that first become
   evident in the tender documents are not submitted to the contracting
   authority at the latest by the expiry of the deadline for application
   or by the deadline for the submission of bids;
   4. more than 15 calendar days have expired since receipt of
   notification from the contracting authority that it is unwilling to
   redress the complaint.
   Sentence 1 does not apply in the case of an application to determine
   the invalidity of the contract in accordance with Article 135, Section
   1 (2). Article 134, Section 1, Sentence 2 remains unaffected.
